Preamble

These Terms of Use and Disclaimer (hereinafter referred to as the “Terms of Use”) define the conditions according to which the website Users (hereinafter referred to as the “Users”) access the website short-edition.com/en (hereinafter referred to as the “Website”), which is operated by Short Édition, a French company registered in France under number #530 552 009, with its principal offices at 12 rue Ampère, Bat. A, Grenoble, 38000, France.

The Website can be used:

  • by authors, whether writers or illustrators (hereinafter referred to as the “Authors”) to allow them:
    • to promote their literary and/or graphic work (hereinafter referred to as a “Work”) to the online community
    • to participate in contests
  • by readers (hereinafter referred to as the “Readers”) to allow them:
    • to discover Works created by Authors and, more generally, any kind of short literary or graphic Work
    • to take part in the online community.

By accessing and using this Website as a User, whether Author or Reader, you accept the following Terms of Use, without limitation of any kind.

1. Use and access

The use of the Website is free. The Users have free access to the Works which are published and to all the Website editorial content. The User acknowledges and agrees that Short Édition is free to modify the Website content (without modifying the content of the Works) at any time, without having to justify it, and without any liability of any kind.

Short Édition has the right at any time and without justification, to refuse, restrain, suspend or interrupt the User’s access to the Website, in whole or in part, if the User does not comply with all stipulations contained in the Terms of Use.

2. Security of the Online Platform

Short Édition puts in place technical means to ensure the identification and authentication of the Users of the Online Platform. The User is attributed a login and a password to access the Online Platform. The User shall ensure the confidentiality of his/her login and password and of the information contained in the Online Platform. The User is responsible for and is committed to take all necessary steps in that purpose. The use of a login and password is considered as a proof of the User’s personal use of the Online Platform.

Under no circumstances shall Short Édition be held responsible for the use (including fraudulent use) of the User’s login and password. The User is committed to immediately notify in writing to Short Édition any communication or any theft of his/her login, password and of any information contained in the Online Platform.

Moreover, Short Édition reserves the right to suspend the User’s login and password at any time if the use he/Short Édition makes of the Online Platform is considered as abnormal, without any possibility for the User to refuse such suspension.

3. Information supplied by the User

The User warrants that the information or data submitted on the Online Platform is real, up to date, full and legal.

The User also warrants that he/she is allowed to supply such information or data and that it is not submitted to any third party’s property right. In such circumstances, the User will defend, indemnify and hold Short Édition harmless against any claim from such third party. In case the User does not respect these terms, Short Édition reserves the right to suspend or terminate his/her use of this Online Platform at any time and without prior notice.

4. Organization of literary contests

Short Édition also organizes literary contests during which new Works are proposed to the Readers.

Each contest is subject to specific official rules which are published on the Website.

Short Édition has sole discretion to issue literary contests or to make general submission periods available to the Author. The Author acknowledges and agrees that literary contests and general submission periods can be simultaneously available, independently available or not available. Short Édition is not committed to have any of these submission modes available and shall not be held liable if the Author is not able to submit a Work.

5. Short Édition’s intellectual property

Short Édition is an international trademark (ref# 1349898) belonging to Short Édition. Any unauthorized use of this trademark would be considered as an infringement of Short Édition’s rights.

Unless otherwise stated, the contents of the Website including, but not limited to, the text and images, are the property of or are licensed to Short Édition.

Nothing contained on the Website shall be construed as conferring directly or indirectly, any right to use or exploit any copyright, patent, trademark belonging to Short Édition or any third party. The Website shall not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, as a whole or in part.

The Readers acknowledge and agree that they will not use the Website in a way that would harm Short Édition or the Authors, and that their use will not result in an infringement of Short Édition or the Authors’ rights or in unfair or unlawful competition.

6. Contents choice and limitation of liability

The Author is responsible for his or her Works which are published on Short Édition’s website and will defend and hold Short Édition harmless from and against any claim related to his or her Works.

Short Édition has no obligation to monitor any Work or any other content which is hosted, transferred or stored through or on the Website. Short Édition cannot be held responsible for any activity or information contained on the Website as long as it was not aware of the unlawful nature of such activity or information, or as long as Short Édition takes all necessary steps to prohibit access to this activity or information when it has become aware of its unlawful nature.

The Website and its contents are provided "as is" and Short Édition makes no representation or warranty of any kind with respect to the Website and/or any information or Work contained or referred to therein.

Short Édition expressly disclaims all express and implied warranties including, but not limited to, the implied warranties of fitness for a particular purpose, title, and non-infringement. In no event shall Short Édition be liable for any direct, indirect, incidental, special, consequential, or other damages (including, but not limited to, loss of profits, business interruption, loss of programs or data, loss of reputation) without regard to the form of action and whether in contract, tort, negligence, strict liability, or otherwise, arising out of or in connection with the Website, any content on or accessed through the Website.

7. Personal data

As per French law, the Website and all the nominative files have been declared to the French National Commission in charge of the monitoring of personal data use (the CNIL).

In application of this law, any User giving personal information through the Website has a right to access and to modify his/her personal data. The User can send his request by mail to Short Édition’s registered office or by email at the following email address: hello@short-edition.com.

The User acknowledges and agrees that Short Édition may keep his/her personal data for one (1) year after his/her account deletion.

These Terms of Use, including all rights and liabilities, shall be governed by the laws of France and the courts of Grenoble, France shall have exclusive jurisdiction over any dispute.
